“Sarkor-Telekom” Ltd, hereinafter referred to as the “Provider” in the person of the director Mr. Roziev F.Z., acting on the basis of the Charter and license UZAPiT PT # 0000214 from the one side and _____________________, in the person of ________________________ acting on the basis of __________________________, hereafter referred to as the “Subscriber” from the other side, have agreed as follows:
1. Subject of the contract
1.1. The Provider renders Subscriber services in the Internet hereinafter referred to as “Services” and the Subscriber uses them in accordance with the Public Offer of "Sarkor-Telekom" Ltd on provision of the Internet access services (hereinafter referred to as the “Offer” located in the Internet at the address: www.sarkor.com and pays them in the order fixed in the present contract.
2.Cost of services and order of payment 2.1. The Subscriber pays the Provider for Services on terms of 100% prepayment.
2.2. The amount of payment is established in accordance with the tariff plan chosen by the Subscriber. Cost and detailed information on the Provider’s tariff plans are provided in the Offer.
2.3. Cost of services and order of payment can be changed by the Provider in unilateral order.
3. Obligations of the parties
3.1. The Provider undertakes to:
3.1.1. Render the Subscriber Services in accordance with the Offer.
3.1.2. Give the Subscriber notice about forthcoming changes in the order of rendering Services and other changes in the Offer on its official site www.sarkor.com 10 day prior to the effective date of changes
3.2 The Subscriber undertakes to:
3.3.1. Meet the requirements stated in the present Agreement and Offer.
3.3.2 Regularly (not less than once a week) visit official site of the Provider in the Internet at the address: www.sarkor.com and enquire for any changes in providing Services.
4. Responsibilities of the parties and arbitration 4.1. All disputes and disagreements between the parties arising while execution of the present contract shall be settled by means of negotiations.
4.2. If disputes cannot be settled by negotiations they are subject to consideration in the Court in accordance with legislation of the Republic of Uzbekistan.
4.3. In all other cases not provided for the present Agreement The Parties bear responsibility for violation of undertaken obligations under the Agreement in accordance with acting Civil Code of the Republic of Uzbekistan.
5. Effective period and termination order of the Agreement 5.1. The present Agreement comes into force from the date of its signing by the Parties. Effective period of the present Agreement is unlimited.
5.2. The present Agreement can be terminated by the Parties on condition of non-fulfillment of the terms and obligations under the present Agreement and also on the ground provider for the Offer and Civil code of the Republic of Uzbekistan.
5.3. Either party is entitled to terminate the present Agreement in one-side order giving written notification to the other party ten days prior to the proposed termination date.
6. Force-majeur 6.1. Neither of the party shall bear responsibility for any delays in fulfillment or non-fulfillment of their obligations under the present Contract, should such delays or non-fulfillment be caused by the circumstances or reasons that beyond the Parties’ control and regarded as force-majeure. The Parties in short time shall notify in written one another about the arisen circumstances.
7. Other provisions 7.1. The present Contract is made in two copies, one copy per each party of equal legal force.
7.2. The offer is an integral part of the present Contract.
7.3. The Provider reserves the right to change any point of the present Contract as well as the Offer notifying about this on its official site 10 (ten) days prior to the effective date of changes.
7.4. In case of disagreement with forthcoming changes in the Contract or Offer the Subscriber stops using Services prior to effective date of changes and notifies the Provider in written (e-mail, fax or personally) about his decision to terminate the Contract.
7.5. Services not pointed in the Contract or not rated in the Offer and special conditions of this Contract execution shall be reflected in the additional Agreement signed by the Parties.
7.6. In cases not provided for the present Agreement the Parties shall be guided by the Acting legislation of the Republic of Uzbekistan.
